New York Robbery Cases

Robbery is an extremely serious allegation. The punishments for these crimes in New York can mean years, or decades in prison. If you or a loved one is facing Robbery charges, choosing an Attorney to defend your case is one of the most important — if not the most important — decisions you will ever have to make. It is absolutely critical that you retain the services of an aggressive, highly experienced CRIMINAL DEFENSE Attorney with a proven track record as soon as you possibly can. Robbery is defined in New York Penal Law 160. Robbery is a theft accompanied by force or the threat of force. Even if you are unsuccessful in your attempt to steal, you may still be charged with attempted Robbery.

There are three degrees of Robbery. The lowest is Robbery in the Third Degree. Robbery in the Third Degree is a class D Felony, and it carries a maximum punishment of Seven Year in prison.

There are several aggravating factors that may increase the charge of Robbery in the Third Degree, as well as the punishment associated with it. For example, a Robbery in the Third Degree becomes Robbery in the Second Degree, if the person committing the Robbery is aided by another person who is present or tif he or she causes a physical injury to any person who is not a participant in the crime; or he or she displays what appears to be a pistol, revolver, rifle, shotgun, machine gun or other firearm. Car Jacking is also Robbery in the Second Degree. Robbery in the second degree is a class C Felony and includes a maximum sentence of 15 years in prison.

Robbery in the First Degree exists when a Robbery is committed and while either committing the Robbery or in fleeing the Robbery, the perpetrator of that Robbery causes serious physical injury to any person who is not a participant in the crime; or is armed with a deadly weapon; or uses or threatens to use a dangerous instrument; or displays what appears to be a firearm. Robbery in the First Degree is a class B Felony and carries a maximum 25 years in prison.
