We will challenge the evidence presented against you by the prosecutor and carefully assess and evaluate the evidence against you to provide the most vigorous defense, and to give you the best advice with respect to how to handle your matter. We fight to protect your Civil Rights as we provide you with a thorough and ethical Criminal Defense.

Criminal charges can completely change your life. Although the law states that you are innocent until proven guilty, the fact is that you may have severe consequences from the moment you are arrested, or even accused. Seemingly simple arrests for offenses like Unlawful Possession of Marihuana (Marijuana), DWI and Theft may lead to deportation of denial of United States citizenship if you are not a citizen of the United States. Our Criminal Defense Lawyers work closely with immigration Attorneys to ensure that your criminal case does not have undue immigration consequences.

The New York State Penal Law is an extensive body of laws which make many acts criminal. Ignorance of the law is not a defense. If you are stopped by the police, remain silent, remain calm, and ask to speak to an Attorney. Even if you are innocent, it may be harmful for you to speak to law enforcement. One of our most valuable rights is the right to remain silent.

Having experienced and diligent legal counsel is essential because if you are convicted, the results may include substantial jail time and often expensive fines imposed by the court.

Our New York Criminal Defense Attorneys also have extensive experience representing college students who have criminal charges against them. Seemingly minor charges like Marihuana possession and Petit Larceny can have devastating consequences for college students. These charges can lead to denial of student loans, and even expulsion from school. If you, or a loved one is a college student facing criminal charges contact us immediately so that we may help you effectively resolve the case while preserving your ability to complete your education.

Bail Hearings

New York Bail Bond Lawyers

Mayo Bartlett is a seasoned Criminal Defense Lawyer who has the experience and dedication that you or your loved one needs on their side when facing any kind of criminal charge whether it is Village Court, Town Court, County Court, Supreme Court, or Federal Court.  He is a former Westchester County prosecutor who served more than 10 years in the Westchester County District Attorney’s Office in White Plains New York. He has also been a Criminal Defense Attorney since 2003, and he has a thorough understanding of police procedure from years spent working with officers and detectives in White Plains, throughout Westchester County, Putnam County, New York City and the Hudson Valley. He has handled thousands of criminal cases, and has successfully reduced the many violent felony charges to misdemeanors, or had them dismissed entirely. He has obtained a verdict of not guilty for a variety of violent charges that would have resulted in sentences of decades, and sometimes life in prison.

Why Bail is an Important Part of Criminal Defense

Bail is one of the most important issues when trying to mount a successful defense of any criminal case. We are Bail Lawyers who will make a very thorough bail application for you or your loved one after an arrest. Many people end up entering guilty pleas to crimes that they did not commit because they want to get out of jail. Although lots of people believe that they would never enter a plea to something that they did not do, this is far from the case. Many people enter false guilty pleas for a variety of reasons.

These reasons include, but are not limited to the following:

  • Fear of losing one's job
  • Fear of losing one's children to foster care
  • Not being able to pick your children up from school
  • Not having one's medicine
  • Fear of a long jail sentence followed by a promise of immediate release after a plea
  • Fear of being victimized in jail

The Kalief Browder Tragedy

The story of twenty-two-year-old Kalief Browder sheds light on how important bail decisions are. Mr. Browder spent three years imprisoned in Riker’s Island, which is thought to be one of the nation's most violent prisons. Kalief Browder was unjustly arrested for allegedly stealing a backpack when he was only 16 years old, and the court set bail at $3000.00. While in the jail, he was repeatedly beaten, and abused by the staff as well as by other inmates, many of which were captured on video. Mr. Browder's case was eventually dismissed, and he was released from prison.

Despite his release, Kalief Browder continued to suffer from his experience at Riker's Island, and in June of 2015, he hanged himself with an air conditioning cord. His story was the impetus for a nationwide movement for a presumption of pre-trial release in lieu of bail. Mr. Browder's story is detailed in a six-part documentary TIME: The Kalief Browder Story.

The punishments for many crimes in New York can mean years, decades, or even life in prison, without the possibility of parole. If you or a loved one is facing criminal charges, choosing an Attorney to defend your case is one of the most important — if not the most important — decisions you will ever have to make. It is absolutely critical that you retain the services of an aggressive, highly experienced Criminal Defense Attorney as soon as you possibly can.

Maintaining Your Freedom

Maintaining your freedom is essential to your ability to successfully defend criminal allegations. If you are not in jail, you are able to assist in your own defense by being able to contact witnesses, by being able to have confidential meetings with your Lawyer, and by being able to work so that you may financially tackle the expenses that may associated with a proper defense. Our Bail Lawyers will stress your presumption of innocence, and the fact that the primary purpose of bail is to assure that you will return to court. We have had remarkable success in having our client's released in their own recognizance even when they faced serious felony charges. We will assertively argue for your release.

Mayo Bartlett has extensive experience in New York State, and Federal Criminal Courts, and he is familiar with every aspect of handling all types of criminal cases from arraignment and bail applications, through motion practice, discovery and trial. Our Bail Lawyers are part of a Criminal Defense team that works frequently with private investigators and forensic experts to provide you with the best defense.

The Westchester County District Attorney's Office has changed its long standing bail policy to include a presumption of release in one's own recognizance for misdemeanors where the person charged does not have an extensive criminal history and is charged with a non-violent crime. The office changed its policy to "promote fairness and end unnecessary incarceration for impoverished defendants," according to an office spokesperson. Governor Andrew Cuomo has also supported pretrial release in cases where a person is charged with a misdemeanor or a non-violent felony. Nevertheless, bail is in the hands of the judge, who ultimately makes the decision between release, bail, or remand.
